PagePilot Terms of Service

These Terms of Service ("Terms") govern access to and use of the PagePilot software-as-a-service platform, including its APIs, admin dashboard, public site renderer, documentation, and related services (collectively, the "Services"). PagePilot is owned and operated by DLVX Studio SRL, a Belgian company registered under number BE0802.384.691 with its principal office at Chaussée de Wavre 287, 1390 Grez-Doiceau, Belgium ("PagePilot", "DLVX", "we", "us"). By creating an account, signing an order form, or using any portion of the Services, the organization you represent ("Customer", "you", or "your") agrees to be bound by these Terms.
If you are accepting these Terms on behalf of a company or other legal entity, you represent that you have authority to bind that entity. If you do not have such authority or if you disagree with these Terms, you must not access or use the Services.
1. Account Registration & Administration
- You must provide accurate account information and keep it current. Account credentials must be kept confidential.
- Customer is responsible for all actions taken under its tenant, including by employees, contractors, or invited collaborators.
- We may communicate with you via the email address associated with your account (for example

2. Subscription, Trials & Fees
- Access to production tenants may require a paid subscription as described in an applicable order, invoice, or pricing page.
- Unless stated otherwise, subscriptions automatically renew for successive terms and fees are billed in advance.
- All fees are non-refundable except where required by law. You remain responsible for applicable taxes.
- Trial or beta features are provided “as is” and may be discontinued at any time.
3. Customer Content & Ownership
- "Customer Content" includes any data, text, images, media, forms, bookings, analytics, or configuration you upload or create inside the Services.
- Customer retains all rights to Customer Content. You grant PagePilot a limited, worldwide, non-exclusive license to host, process, transmit, and display Customer Content solely to provide and improve the Services.
- You represent that you have obtained all necessary rights, consents, and permissions to submit Customer Content and to permit its use under these Terms.
4. Platform Features & Changes
- We aim to maintain continuous availability, but uptime or feature roadmaps are not guaranteed unless expressly agreed in writing.
- The Services may evolve. We may add, change, or remove features to improve performance, security, or user experience. Material changes that reduce core functionality will be communicated in advance when reasonable.
- We may offer integrations with third-party tools. Use of those tools is governed by their own terms and privacy policies.
5. Acceptable Use
You may not, and must not allow anyone else to:
- Reverse engineer, decompile, or create derivative works based on the Services except as permitted by law.
- Interfere with or disrupt servers, APIs, or networks connected to the Services.
- Upload malware, infringing content, or data that violates privacy laws or the rights of others.
- Attempt to gain unauthorized access to other tenants or PagePilot infrastructure.
- Use the Services for unlawful, harassing, or fraudulent activity, including unsolicited marketing or spamming end users.
We reserve the right to suspend or terminate access for activity that violates this section or that, in our reasonable judgment, poses risk to the platform or other tenants.
6. Security & Data Protection
- We maintain administrative, technical, and physical safeguards designed to protect Customer Content. No system can guarantee perfect security; you should export copies of critical data on a regular cadence.

[email protected]. - Our collection and use of personal data are described in the PagePilot Privacy Policy.
7. Confidentiality
- "Confidential Information" includes proprietary business, technical, and security information shared by one party to the other that is marked or reasonably understood as confidential.
- Each party will use the other party’s Confidential Information only to perform obligations under these Terms and will protect it with the same degree of care it uses for its own confidential data.
- Confidentiality obligations survive termination for three (3) years, except for trade secrets which remain protected until no longer a trade secret.
8. Intellectual Property
- PagePilot (and/or its licensors) retains all rights, title, and interest in the Services, documentation, and underlying technology.
- No rights or licenses are granted except as expressly stated in these Terms. Feedback or improvement suggestions you provide may be used without restriction.
9. Service Availability, Support & Maintenance
- Scheduled maintenance windows will be announced in advance when feasible. Emergency maintenance may occur without notice.
- Support is available via [email protected] or through designated channels noted on your order form.
- We may apply usage limits (such as API rate limits or storage quotas) to ensure fair use across tenants.
- To the fullest extent permitted by law, DLVX Studio SRL is not liable for any failure, degradation, or interruption of the Services that is caused by factors outside of our reasonable control (including third-party hosting providers, internet outages, or force majeure events).
10. Term, Suspension & Termination
- These Terms remain in effect for the duration of your subscription (or until you stop using the Services).
- Either party may terminate for material breach if the breach is not cured within thirty (30) days after written notice.
- Upon termination, your access will cease. We will make Customer Content available for export for thirty (30) days unless prohibited by law. We may delete remaining Customer Content afterwards.
11. Disclaimers
- THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE". WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
- WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE, NOR THAT THEY WILL MEET YOUR SPECIFIC BUSINESS REQUIREMENTS. DLVX STUDIO SRL EXPRESSLY DISCLAIMS RESPONSIBILITY FOR FAILURES OR LOSSES RESULTING FROM YOUR NETWORKS, THIRD-PARTY SYSTEMS, OR IMPROPER CONFIGURATION OF THE SERVICES BY CUSTOMER.
12. Limitation of Liability
- TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
- PAGEPILOT’S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS WILL NOT EXCEED THE AMOUNTS PAID OR PAYABLE BY CUSTOMER FOR THE SERVICES DURING THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY.
- THESE LIMITATIONS DO NOT APPLY TO YOUR PAYMENT OBLIGATIONS OR TO EITHER PARTY’S INDEMNIFICATION OBLIGATIONS.
13. Indemnification
- Customer will indemnify and hold harmless PagePilot and its affiliates from any claim, loss, or expense arising from (a) Customer Content, (b) use of the Services in violation of these Terms, or (c) violation of law or third-party rights.
- PagePilot will indemnify Customer against claims alleging that the Services infringe a third-party intellectual property right, provided that Customer promptly notifies PagePilot and cooperates in the defense. If a claim arises, we may modify or replace the Services, or terminate access with a prorated refund.
14. Governing Law & Dispute Resolution
- These Terms are governed by the laws of your country or state of incorporation unless another jurisdiction is specified in an order form. Conflicts-of-law principles do not apply.
- Disputes will be subject to the exclusive jurisdiction of courts located in the governing venue, and both parties consent to personal jurisdiction there. Either party may seek injunctive relief for actual or threatened misuse of intellectual property or Confidential Information.
15. Changes to the Terms
- We may update these Terms from time to time to reflect operational, legal, or regulatory changes.
- Material updates will be communicated via the admin dashboard or email. Continued use of the Services after the effective date constitutes acceptance of the revised Terms.

These Terms of Service do not replace any mutually executed master service agreement. In the event of a conflict, the negotiated agreement controls.
